Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the NetCard digital business card service at netcard.live (the "Service"), operated by Next Vision ("NetCard", "we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, you may not use the Service.

1. Definitions

  • Service — the NetCard web and mobile applications that let you create, publish, and share digital business cards.
  • User or "you" — any individual who accesses or uses the Service.
  • vCard — a digital business card you create using the Service.
  • Content — any text, images, logos, links, and other information you add to your vCards.
  • Paid Plan — a subscription to a premium tier (e.g., Starter, Pro) billed through Stripe.

2. Eligibility and Account

You must be at least 16 years old to use the Service. You agree to provide accurate and complete information when registering and to keep your login credentials secure. You are responsible for all activity that occurs under your account.

3. Description of the Service

NetCard lets you build digital business cards that can be shared via a public URL, QR code, or NFC tag. Depending on your plan, the Service includes features such as custom templates, analytics, scheduling, inquiry forms, and password-protected cards. A free tier with limited features is available, and additional features are offered through Paid Plans.

4. Your Content and License

You retain full ownership of the Content you upload to your vCards. By using the Service, you grant NetCard a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your Content solely to operate and provide the Service to you and the people you share your vCards with.

You represent and warrant that:

  • You own or have the necessary rights to the Content you upload (including photos, logos, and third-party trademarks);
  • Your Content does not infringe on any third party's intellectual property, privacy, or publicity rights;
  • Your Content does not contain unlawful, defamatory, or otherwise prohibited material as described in Section 5.

5. Acceptable Use

You agree not to use the Service to:

  • Impersonate another person or misrepresent your affiliation;
  • Publish unlawful, defamatory, harassing, or discriminatory content;
  • Distribute malware, phishing links, or deceptive URLs;
  • Send unsolicited bulk communications (spam);
  • Scrape, reverse engineer, decompile, or circumvent security controls of the Service;
  • Interfere with or disrupt the Service, its infrastructure, or other users' access;
  • Violate any applicable law or third-party rights while using the Service.

6. Paid Plans, Billing, and Auto-Renewal

Some features require a Paid Plan. Current prices are shown on our pricing page and in your billing dashboard. Prices are in Euro (EUR) and, where applicable, include VAT.

7. Cancellation and Refunds

You can cancel your Paid Plan at any time from your billing dashboard. Cancellation takes effect at the end of the current paid period; you will retain Paid Plan features until that date. We do not prorate partial months.

EU 14-day withdrawal right. If you are a consumer residing in the European Union, you have the right to withdraw from your first purchase of a Paid Plan within 14 days. However, because digital Services begin immediately upon subscription, by starting a Paid Plan you expressly consent to immediate performance and acknowledge that you lose the right of withdrawal once the Service has been fully performed. To request a refund within this period, contact support@netcard.live.

8. Intellectual Property

The Service, including its software, templates, design system, and branding, is owned by Next Vision and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or trade dress without our prior written permission. The rights in your own vCard Content remain yours (see Section 4).

9. Third-Party Services

The Service integrates with third-party providers (Stripe for payments, Google and GitHub for optional OAuth sign-in, Vercel for hosting, Neon for database storage, AWS SES for transactional email). Your use of these providers is governed by their respective terms and privacy policies.

10. Privacy and Data Protection

Our handling of your personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you consent to the data practices described there.

11. Suspension and Termination

We may suspend or terminate your account if you:

  • Breach these Terms or our Acceptable Use policy (Section 5);
  • Fail to pay for a Paid Plan after the grace period;
  • Use the Service in a way that risks harm to us or other users;
  • We are required to do so by law or a competent authority.

You may close your account at any time from your account settings. Upon account deletion, your personal data is removed within 30 days in line with our Privacy Policy. Active Paid Plans are cancelled with no further charges.

12. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, or that any QR/NFC interaction will always succeed on every device. Nothing in these Terms excludes or limits mandatory consumer rights you may have under the law of your country of residence.

13. Limitation of Liability

To the maximum extent permitted by applicable law, NetCard's total aggregate liability arising out of or related to these Terms or the Service is limited to the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if advised of the possibility of such damages. Nothing in this section limits our liability for gross negligence, willful misconduct, or death or personal injury caused by negligence, which cannot be excluded by law.

14. Indemnification

You agree to indemnify and hold harmless NetCard and Next Vision from any claim, loss, or expense (including reasonable legal fees) arising from your Content, your use of the Service in breach of these Terms, or your violation of any third-party right.

15. Changes to the Service or Terms

We may update these Terms from time to time. If we make material changes, we will notify registered users by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. The "Last updated" date at the top of this page reflects the most recent revision.

16. Governing Law

These Terms are governed by the laws of the country where Next Vision is established, without regard to conflict-of-law principles. If you are a consumer residing in the European Union, you benefit from any mandatory consumer protections of your country of residence, which remain unaffected by this clause.
